By processing objective case metrics through a standardized formula, systems can eliminate the erratic fluctuations of human mood and personal bias. However, this approach faces fierce resistance from legal professionals.

Judges routinely reject algorithmic constraints, viewing them as direct threats to their professional autonomy and their ability to exercise mercy or context-specific wisdom. They argue that every case is unique, requiring human empathy. Yet, as Kahneman points out, this defense of human uniqueness often serves as a shield for unchecked, systemic inconsistency, leaving defendants at the mercy of the judicial lottery.
